In this Parsha & Halacha shiur for Parshas Pinchas we will address the case of Sgt. Elor Azariya who killed a terrorist who had already been neutralized and was no longer a threat. This was a trial in the military court that dragged on for some 8 months. What does the Halacha say about such a case? Does the terrorist lose his status as a רודף once he no longer poses a threat, and therefore is to be treated as a full fledged נפש whose killing should be judged as murder? What is the law re: a בא במחתרת who is no longer a threat, e.g. the wall caved in on him & he is buried under the debris? Is is still a Rodef and therefore a גברא קטילא - considered legally dead? Would we violate the Shabbos in order to save his life?
