Description

This is a Parsha & Halacha shiur for Parshas Behar addressing the issue of the buyer was surprised to discover a defect in the product he purchased. Was the buyer aware of the blemish or should he have checked out the merchandise? How much time do we allow for the buyer to claim Mekach TaUs? What if the seller can adduce evidence that the buyer was well aware of the defect and nevertheless went thru with the sale? What if the buyer used the object for his own personal use and now insists that the seller take back the product and return his money? What about merchandise sold in our times by gigantic department stores whose policy is to never sell returned goods? In this situation the seller loses nothing as a result of the buyer's use.
