Halacha for Sefirat HaOmer: counting early without a Beracha with a תנאי. The issue is not limited to Sefira but applies to many mitzvot, does the Halacha recognize the efficacy of a condition in Mitzvot? R' Akiva Eiger seems to validate a תנאי which makes his כוונה לשם מצוה conditional. He can say that in event that the Tzibbur will not make it on time to recite before the Zman Kriyat Shema passes, let this be a recitation for the mitzva, but otherwise this is not a mitzva of K"S. Applying this to Tefillin on Chol HaMoed he can make a similar תנאי in case there is no Tefillin on Ch"Ha"mo. The same could apply to the Omer in case it's too early to count but one wants to join the Tzibbur. We know about the validity of תנאי in קנינים.
