Description

For Masechet Ketuvot 19a we will address the following question: does a Shtar need Kiyum i.e. to be authenticated if the borrower or the witnesses signed on the Shtar admit that the signatures are authentic? In the language of the sugya, מודה בשטר שכתבו. If the Shtar needs Kiyum, then we can apply the principle of הפה שאסר and believe the borrower to claim פרעתי, I have repaid the loan, or the witnesses to invalidate the Shtar for one of three possible reasons.
