Description

The sugya in Masechet Bava Kamma 103a-b addresses the question: must the thief return the stolen object to the נגזל? Is the thief required to locate the victim of his crime in the far flung town of Madai and carry the גזילה all the way to the נגזל? Is this the basic definition of השבת הגזילה? Or is this a special requirement of השבה if the thief took a false oath? How do we reconcile this Mishna with the Mishna in Yevamot in the case of one who stole an object from one of five people, and the thief doesn't know which of the 5 is the נגזל. Must he return the object to each of the five? The controversy between R'Tarfon & R' Akiva.
