Description

The principle of Aseh doche Lo Ta'aseh עשה דוחה ל"ת only applies when the Mitzvas Aseh is fulfilled at the moment of the violation of the Lo Ta'aseh, בעידנא. But Tos' maintains that the Mitzva of Tzitzis is only fulfilled AFTER the donning of the garment. Yet the Issur of כלאים is violation at the moment of לבישה, so where is the בעידנאto generate דחייה? We will study the insights of Reb Elchonon based upon the 'splitting' of a Mitzva into its two component parts: the Mitzva act & the Kiyum HaMitzva. We will define the act of donning the garment as the legal מעשה מצוה. In a similar vein we will define the shaving off of the hair of the מצורע as a Maaseh Mitzva which begins with the cutting of the 1st hairs & the violation of the Nazir.
