Description
We complete the sugya we began in Bava Matzia 24b and discuss more about the location where the object was found and the make-up of the population in that location. Was it a densely populated area? Mostly populated by Jews or non-Jews? How far did Rebby Shimon go in permitting the finder to keep the object due to the volume of human passers by in that location? And do we pasken like R' Shimon? Another issue: what is the Halacha regarding returning the object to its owner after יאוש? The sugya introduces the concept of לפנים משורת הדין. Is our case of returning a lost object after יאוש a classical application of this concept? And can we coerce the finder to fulfill לפנים משורת הדין?
