iIn this Halacha shiur for Parshas Shoftim we seek to define the principle of הפקר בית דין הפקר which establishes the broad authority of Beis Din in the area of ownership rights in Choshen Mishpat. How far does this authority extend? We know that Beis Din established שמיטת כספים even in our time which removes the rights of the lender to collect his debt. But can Beis Din take money out of the possession of Reuvein and award Shimon ownership over that money?
