Description
We will look at a number of sugyos in the first Perek of Chullin with the goal of addressing the question: what are the sources in the Torah for חזקה ורוב? Why do we need a source at all, aren't these principles logically dictated? We will study Masechet Chulin 11a and the Tos' there to try to set up two distinct categories of רוב, one that is explicit in the Torah & a 2nd that is implicit and underlies a number of Parshiot of capital crimes. We will focus on the case of a murderer who is put to death based upon the רוב that dictates that the victim was healthy rather than a Tereifa.
