Description

An analysis of the sugya of Bar Gozla, the Psak of the Ramah at the end of siman #91, & Tos' in Chulin 96b. Tos' establishes a new Halacha, i.e. that even two cold foodstuffs generate a מקצת בליעה and generate a requirement of כדי קליפה if the food has been cooked. The Ramah codifies this חומרא of Tos'. But what forced Tos' to accept this position? It was his interpretation of the sugya of Bar Gozla. What compelled Tos' to assume that the case of צלי in that sugya is cold צלי? Tos' thought that if the צלי was hot there should be a requirement of כדי נטילה; Klipa would be insufficient. This is because Tos' rejects the principle of the Rashba re: תתאי גבר. How then can the Shach opine that the Ramah accepted the קולא of the Rashba?
