Description

This is an introduction to Jewish Business Ethics and the study of Choshen Mishpat. Our goal is to demonstrate the overlap between two main branches of Halachik monetary law, the laws of פועךים, i.e. labor relations, and the law of damages נזיקין, tort law. The main issue is the relationship between the employer & his employee. The latter was hired for one particular work and now the former wishes to change the conditions of the work agreement and demand that the laborer execute a different category of labor in order to earn his salary. Does the employer have the right to do so? Can the employee demand higher wages? What if the employer has no work for the פועל and the latter claims he will suffer a loss as a result?
