Description
The sugya compares two Syag'im regarding Kriat Shema shel Arvin: the Syag prohibiting eating before Kriat Shema & the Syag requiring the recitation of K"S before Chatzos. Both of these Rabbinic requirements were instituted for the very same reason, i.e. להרחיק את האדם מן העבירה. Yet the laws that apply to these two requirements are fundamentally different. If one eats before Kriat Shema and violates the Syag, nevertheless he reads Shema and obtains the Kiyum HaMitzva. In contrast, according to the Rambam & Rabenu Yona the Chachamim nullified the Kiyum of Kriat Shema after Chatzos. Why then does the sugya assume an analgy between two Syag'im that are so fundamentally different? Is the prohibition of eating an Issur Achila or a K"S Halacha?
