Description

The Torah requires that a criminal receive 40 Malkot, yet the sugya in Makot establishes that Beis Din give only 39 lashes. The Rambam would seem to assume that the Rabanan were able to make this change & reduce the Malkot by one under their authority of "Asu S'yag La"Torah". In this shiur we will try to understand the Rambam, and present a number of explanations as to the meaning and goal of Malkot, as well as the significance of the numbers 39 & 40 in this context.
