Description

Our discussion will be divided into two major topics addressed by the sugya: a)First, what is the din for Psulei Eidus DeRabanan, e.g. a professional gambler (mesachek b'kubya) as far as a chiyuv Korban Shvuah is concerned? The plaintive in a monetary case imposed an oath on this witness, and the witness refused to testify. It would seem clear that the Parsha of Korban Shavuah would be inapplicable since the testimony of the Pasul DeRabanan is irrelevant & the plaintive suffered no loss. We will study 2 approaches offered by the Rashba. Second, why does R' Yochanan need two sources for the Issur Chatzie Shiur? a) The Drasha of Kol Chelev, b) the svara of Chazy L'itztarufy? This will lead us to the chakira about the nature of chatzie shiur.
