We continue our study of te Laws of Shvi'it with focus on the mitzvah of "u'Netashta", i.e. to make the produce of one's field Hefker and allow public access to the fruits of the field. Does this require an active Maaseh Hefker or is Hefker automatic due to Afkata DeMalka? What happens if the owner violated the Hefker requirement and blocked others from gaining access to the fruits? These fruits are called Nishmar, and we will investigate their Halachik status. What is the status of Ne'evad, i.e., if the owner worked his field during shviit and produced the fruit? Is the owner penalized and the fruit prohibited? We find a precedent to such an Issur in the laws of Maaseh Shabbos.
