In this shiur we will study the shitat HaRamban on Shvi'it BiZeman HaZeh, is it DeOraita or Derabanan? Although the Kesef mishna explains the Rambam's statement that Shvi'it is Derabanan in our time as referring specifically to Shmitat KeSafim rather than to Shmitas HaAretz (=Karka), the evidence from the text of the Rambam strongly indicated the contrary. But why would Shvi'it be only DeRabanan since Kedushat HaAretz is Deoraita? Could the Rambam be maintaining that Shvi'it, like Teruma, requires "Bi'as Kulchem"? We will study the insight of HaRav Ozer shlita based on the chiddush of Reb Chaim Brisker.
