Rashi & Tos' at the beginning of Ktuvot debate the underlying reason for the takana that a Betula marry on Weds. night so that the husband come to Bet Din on the following morning to establish his claim of "Petach Patuach Matzati". The Ran expands upon the view of Rashi. This shiur will analyze the two opinions, that of Rashi & Tos' in the light of two fundamentally different definitions of Sfek Sfeika. We will also address the controversy at the beginning of Yoreh Deah regarding the concept of Rov in the case of a shochet whose expertise is unknown. These two definitions will shed light on a controversy regarding sfek sfeika in monetary law as well.
